Justice Department Seeks Judge’s Recusal in Georgia Election Case

6 days ago 0

The U.S. Department of Justice is asking a federal judge to step down from a case involving Georgia election records. This request comes amid concerns about potential impartiality. The judge, who attended an event honoring Fulton County District Attorney Fani Willis, has raised questions about her ability to remain unbiased.

Judicial Misconduct Allegations

In the 11th Judicial Circuit, a federal judge received a private reprimand after a court investigation. The investigation found that the judge engaged in inappropriate behavior at the courthouse, including having a sexual encounter with a police officer and attending a partisan event. Although the judge’s identity was not publicly revealed, media reports have named U.S. District Judge Eleanor Ross in Atlanta.

The Justice Department’s motion relies on these media reports, though the Associated Press has not independently confirmed the judge’s identity. Judge Ross has not commented on these allegations, and her office has directed inquiries to the court’s media relations team.

Judge’s Background

Federal judges hold lifetime appointments but can face disciplinary actions such as reprimands or even impeachment by Congress. Judge Ross was appointed by President Barack Obama in 2014, confirmed by the Senate later that year. She previously served as a state court judge in Georgia from 2011 and has a background as a prosecutor in both state and federal courts.

Georgia Election Records Dispute

Judge Ross is currently overseeing a case filed by the Justice Department against Georgia Secretary of State Brad Raffensperger. The lawsuit involves Georgia’s voter lists, which Raffensperger argues are protected by state law. The Justice Department has requested a delay in an upcoming hearing while seeking Judge Ross’ recusal.

Controversial Past Cases

District Attorney Fani Willis, previously linked to Judge Ross, had initiated an investigation into Donald Trump and others regarding alleged interference in the 2020 elections. This investigation led to an indictment that was later dismissed due to perceived conflicts of interest involving Willis.

The Justice Department contends that Judge Ross’ attendance at Willis’ election party could lead to perceptions of bias. This connection, the Department argues, could cast doubt on Judge Ross’ ability to impartially oversee the election records case.

Additional Allegations

While the recusal motion focuses on questions of judicial bias, it briefly mentions prior allegations regarding sexual misconduct in chambers. An Atlanta Police Department investigation is underway to verify whether the involved police officer belongs to their force.
