Betancourt, who has lived in the United States for many years, encountered detention lasting over six months after an immigration check-in, as detailed in court records. His release from Immigration and Customs Enforcement (ICE) custody occurred on May 14, following a judge’s order. Legal representatives for Betancourt effectively argued that he was wrongfully detained, resulting in a habeas corpus decision that required his release.

Betancourt arrived in the United States in 1990, securing lawful status later. However, a 2020 order from an immigration judge called for his removal following convictions, including conspiracy to distribute methamphetamine, as recorded in court documents dated May 13 related to his case. As a Cuban national, immediate deportation was unfeasible, prompting authorities to release him under supervision, requiring regular check-ins.
During one such check-in on October 29, 2025, Betancourt was re-detained, according to the court filings. An attempt to deport him to Mexico in January 2026 failed when entry was denied due to his medical and mental health conditions, as per the court documents.
