A federal judge has prevented the U.S. Postal Service from enforcing an executive order concerning mail-in ballots. This order, issued by President Donald Trump, required states to submit a list of mail-in voters before the postal service could transmit ballots.
U.S. District Judge Emmet Sullivan stated that implementing the order would breach the settlement from a 2020 lawsuit between the postal service and the NAACP. This settlement involved court oversight of the postal service’s handling of ‘Election Mail’.
The Proposed Rule violates paragraph 2 of the Agreement because the Postal Service cannot post documents reflecting ‘practices and policies for prioritizing the monitoring and timely delivery of Election Mail’ if its policies provide that it will not accept ‘noncompliant mailing’ and therefore will not deliver mail-in or absentee ballots to some voters, and if it will not mail ballots to any voters in a state where the state ‘declines or fails to certify a list,’Sullivan wrote.
The ruling, which spans nationwide, follows a case where nearly 25 states contested the order earlier this year. These states succeeded in blocking its execution within their jurisdictions.
The decision by Judge Sullivan coincides with a similar case involving another attempt to restrict noncitizen voting. This involved Executive Order (EO) 14248, signed in March, aimed at forming a federal voter registration list and enacting restrictions on mail voting eligibility.
An official statement from the White House, given by spokeswoman Abigail Jackson, underscored President Trump’s goal of maintaining confidence in election administration. Jackson expressed belief that the order protects elections and will ultimately be implemented.
