Tampa Bay Rays shortstop Wander Franco was found criminally responsible for abusing a minor, yet he will not face a sentence. A Dominican judge declared this decision on Monday.
Judge’s Ruling
Judge José Antonio Núñez explained that Franco had suffered extortion and blackmail by the minor’s mother. She received a 10-year sentence for sexually trafficking her daughter. Núñez stated, “It seems contradictory to declare criminal responsibility and at the same time exempt him from punishment.” He added that Franco was granted a judicial pardon due to being a material victim but not a legal one. The judge called this reasoning both logical and legal.
Franco’s Reaction
Expressing gratitude, Franco embraced his mother, Nancy Aybar, and family in court, stating, “Thank God for everything.” Franco, arrested in January 2024 for allegedly having a relationship with a 14-year-old, reportedly transferred money to her mother for consent to the relationship.
Following the court ruling, Franco left the courthouse with his lawyer, Teodosio Jáquez. He told reporters he felt calm and urged fans to keep supporting him. Franco mentioned he hadn’t contacted the Rays, though his lawyers likely had.
Future Proceedings and MLB’s Statement
Franco’s attorney, Jáquez, noted that while they have yet to receive the physical sentence, the court exempted Franco from punishment due to his victim status and the judicial pardon. The complete sentencing will be available on June 16. Jáquez stated, “When we have the full sentence in hand, we will give you more details.” Franco had been placed on a restricted list by Tampa Bay, halting his pay while on administrative leave.
Major League Baseball acknowledged the ruling, noting their investigation would conclude at an appropriate time.
Franco’s career, which began with an 11-year, $182 million contract in November 2021, faced disruption when investigations into his actions began in August 2023.
