Federal Judge Halts Warrantless Immigration Arrests in Oregon

In a significant ruling on Wednesday, a federal judge prohibited the Department of Homeland Security (DHS) from performing immigration arrests in Oregon without having individualized assessments regarding flight risks. This decision follows a pattern of allegedly unlawful arrests conducted by federal agents. U.S. District Judge Mustafa Kasubhai issued a preliminary injunction in a class-action lawsuit against DHS and U.S. Immigration and Customs Enforcement (ICE) as the legal proceedings continue.

The court determined that agents frequently apprehended individuals for purported immigration violations without warrants and without evaluating whether those individuals were at risk of fleeing before warrants could be secured. Judge Kasubhai instructed the government to inform immigration officers, employees, agents, and contractors of the ruling. Additionally, he mandated the documentation and regular reporting of any future warrantless arrests, including detailed, case-specific justifications for those arrests.

The Associated Press highlighted instances where immigration agents in Oregon executed enforcement operations, arresting people without warrants or individualized flight risk assessments. During a comprehensive hearing, the court heard from Victor Cruz Gamez, a 56-year-old grandfather, who shared his ordeal of being detained during a traffic stop while returning home from work.

“Due process calls for those who have great power to exercise great restraint,” Kasubhai remarked. “That is the bedrock of a democratic republic founded on this great Constitution. I think we’re losing that.”

Cruz Gamez, who had been living in the United States for over two decades, testified that despite presenting his driver’s license and work permit, he was detained and held for three weeks. His detention occurred despite having legal work authorization and a pending visa application. He recounted being taken to an ICE facility in Portland and then transferred to a detention center in Tacoma, Washington. During this time, he faced the threat of deportation until an attorney intervened to secure his release.

Emotional as he described the arrest’s impact, Cruz Gamez told the court that his family, especially his wife and grandchildren, were too fearful to leave their home for weeks. A government lawyer later expressed regret to him for the distress caused to his family.

This case underscores the judicial emphasis on the importance of due process and the restraint required when exercising significant power, serving as a reminder of the foundational principles of the democratic system.
