Judge Overturns Trump Guidance Limiting Green Energy Credits

A federal judge has overturned guidance from the Trump administration that restricted tax credits for renewable energy projects. The decision is seen as a significant win for supporters of solar and wind energy. However, the ruling arrives just weeks before a critical deadline under the Republicans’ legislation known as the ‘Big Beautiful Bill.’ This law aims to phase out these tax credits entirely, casting uncertainty on the potential impact of the court’s decision.

The ‘One Big Beautiful Bill Act’ passed last year, phases out solar and wind energy tax credits. Projects qualify for credits only if construction begins before July 5, 2026, or if they are in service before 2028. The crux of the legal issue involves the Internal Revenue Service’s (IRS) definition of the term ‘starting construction.’

Since 2013, the IRS has recognized two ways to start construction: by undertaking ‘physical work of a significant nature’ or by incurring at least five percent of a project’s total cost. However, under Trump’s guidance, only the ‘physical work’ method was valid. D.C. federal Judge Colleen Kollar-Kotelly noted that excluding the five percent cost pathway was arbitrary and capricious, leading her to overturn this guidance.

Judge Kollar-Kotelly, appointed by Clinton, pointed out that despite the court’s ruling, renewable developers might still face uncertainty due to the looming July construction deadline. She explained, ‘significant uncertainty will exist no matter how this Court resolves this case and what remedy it awards.’
